What is a Closed Period of Disability?

A closed period of disability is defined as the time between the onset of disability (when an individual can no longer work) until the time that the individual was able to return to work on a regular and continuous basis.

To qualify for a closed period of benefits, you must be able to prove that an injury or illness prevented you from working for at least 12 consecutive months. You may apply for these benefits as soon as you are unable to work. If you did not realize that your condition would persist for 12 months, you can apply later. In fact, if you fail to file an application because you were unaware that you were eligible, Social Security will allow you to file for this type of benefit any time within 14 months after the disability ended.

If you or a loved one has suffered an injury or illness that has or may require an absence from work for a year or more, call Golson, McCracken for a free and confidential case analysis.
